CISG默示排除规则在中国法院的适用

The article is a specialized study on the application of the implied exclusion rule of the United Nations Convention on Contracts for the International Sale of Goods (CISG) in the Chinese courts. After investigated empirical and typological analysis of 288 cases and contradictory practice practices, the article proposed a typological approach to the courts in different situations after considering the history of the Convention, the practice of different national courts and tribunals, and doctrinal analysis.
The thesis “The Application of the Implied Exclusion Rule of the United Nations Convention on Contracts for the International Sale of Goods in Chinese Courts” was awarded the title of ‘Outstanding Graduation Thesis’ at the university level.
